You decide whether and how to use each result. You are responsible for checking it and for every filing decision, deadline and fee.
Who provides the service
Parsing Sàrl, operating as ogram in Lausanne, Switzerland, provides the public Swiss Trademark Deposit plugin and website. enodo contributed to the workflow; use of the plugin does not engage enodo or its personnel to act for you. These terms apply when you access or use the hosted service. If you use it for an organisation, you confirm that you are authorised to do so.
What the plugin does
The plugin retrieves dated reference material and assists with trademark classification, wording, preliminary issue spotting and search planning. It does not file applications, conduct a complete live clearance search, check every earlier right, pay fees, monitor deadlines, or decide whether a sign is registrable or safe to use. It is independent of the Swiss Federal Institute of Intellectual Property, WIPO, Swissreg and the courts.
Neither the plugin nor its output is legal advice or a professional opinion. Using it creates no lawyer-client, advisory, fiduciary or agency relationship with Parsing Sàrl, enodo or their personnel. A separate written engagement, if any, governs that engagement.
Your responsibility
Results, citations and AI-generated explanations can be inaccurate, incomplete, outdated or unsuitable for your facts. Before relying on them, you must verify current official sources, conduct any needed live searches, obtain appropriate professional advice, and independently review all proposed wording. You alone decide what to use, submit or publish and bear the consequences of that decision, including refusals, oppositions, missed deadlines and third-party rights claims, subject always to the non-excludable rights stated below.
Provide only information you are entitled to share and that is needed for the task. Do not send passwords, payment details, government identifiers or health information. Send confidential client material only when it is necessary for the task and you are entitled to share it with the AI client and hosting providers. Your use of results and third-party source material must respect applicable law and the rights of others. The source notes explain the corpus and its limits; no third-party reuse licence is granted by these terms.
Access and acceptable use
The hosted service is currently offered without a separate service fee, subject to capacity and rate limits. Your AI client may have its own terms, fees and data practices. Do not attack the service, bypass limits or security controls, submit malicious instructions, interfere with other users, or use it for unlawful or misleading filings. We may restrict or suspend access to protect the service or comply with law.
Availability and warranties
We may correct, update, interrupt or end the service. To the extent permitted by law, it is provided as available, without a warranty that it will be uninterrupted, error-free, current, complete, fit for a particular filing, or accepted by any authority. You should not rely on its availability for a deadline.
Liability
To the extent permitted by applicable law, Parsing Sàrl and enodo, and their respective personnel and contributors, are not liable for losses arising from your use of or reliance on the service or its results, unavailable service, outdated reference data, third-party platforms, or your filing and commercial decisions. This includes lost profits, lost opportunities and indirect or consequential loss. These protections are intended for both Parsing Sàrl and enodo, and each may invoke them where the law permits.
Nothing in these terms excludes or limits liability for intentional wrongdoing, gross negligence, or any liability or user right that cannot lawfully be excluded or limited. If your unlawful material or deliberate misuse causes a third-party claim against Parsing Sàrl or enodo, you are responsible for the resulting reasonable losses and costs to the extent permitted by law and to the extent they were not caused by our own conduct.
Privacy, changes and disputes
The privacy notice explains how the hosted service handles data. We may revise these terms for future use; the date above will change when we do. Swiss law governs, subject to mandatory consumer and data-protection rules. Courts at the seat of Parsing Sàrl have jurisdiction where a valid choice of court is permitted; mandatory courts remain available. Contact info@ogram.ch with questions.
